REVEALING REPORT OF JUDICIAL POWER
Por translation: mark - Monday, Oct. 04, 2004 at 2:10 PM

Sunday 3rd of October, 2004 Chubut: Justice discovers its own absence An internal investigation of the Chubut justice confirmed that the police and its very own judicial system is deliberately violating human rights and discriminating against a specific group of people : the small producers and the indigenous communities. In spite of the evidence, almost all of the defendants continue imparting “justice”. The report, although public, has been barely diffused.

For the first time, a public prosecutor of Chubut investigated the actions of its peers and verified the violation of human rights and explicit discrimination on the part of the police and the judicial system against small owners and indigenous settlers. "The operations (of the Judicial Power and the Police) reinforce the belief that Justice is only for the rich and powerful, and that for everyone else there only exists injustice", accused the investigation headed by the fiscal (1) Rafael Lucchelli. In spite of the evidence collected in the report, almost all those linked to the violations of human rights - as much from the judicial system as of the provincial police – are still working today . The report was born with an accusation of the social organization Regional Humanista Latinoamericana and was taken on by the General Proxy (Procurador General) of Chubut, Eduardo Samamé, the head of public prosecutors of all the province. The lawyers of the victims affirm that Samamé binned the report and accuse him of not taking action on the officials questioned.

Men that faced up to local power and reappear hanged in police stations, small owners of coveted lands that are disappeared so that their few hectares remain in the hands of large landowners and violent evictions of mapuche families ordered individuals with help by the police. They are some of the cases investigated by the public prosecutor of Puerto Madryn Rafael Lucchelli and his collaborators Miguel Santos and Rodrigo Freire Méndez. The conclusions, according to all the lawyers that work with indigenous peoples, are as hard as they are unusual. This, they say, explain its non-diffusion in Chubut.

The fiscal (1) Lucchelli explained that his work "proved that the Argentine State, through diverse institutions, allowed and/or executed the violation of human rights. In the case of indigenous peoples, the violations are even more notorious". In a brief dialogue he assured that he did not know of the present situation of the cases and avoided evaluating the report post investigation, which tallies with his boss Samamé, who refused to speak of the subject.

(1) fiscal translates to both attorney general and prosecutor. I’m unsure which is meant.
