URGENTE

1.- El Relator Especial para Investigar las Detenciones Arbitrarias fue nombrado por la Resolución 01/2006 del Comité Internacional sobre Detención Arbitraria, la cual precisó su mandato por la Resolución A/RES/53/144 de fecha 8 de marzo de 1999 y se amplió por la Resolución A/58/380 de fecha 18 de septiembre de 2003, ambas emanadas de la Asamblea General de las Naciones Unidas, actuando de conformidad con sus métodos de trabajo, el Relator es delegatario de un Mandato a ser cumplido por los países miembros de ONU de acuerdo a la Carta de la Organización.

2.- El Relator Especial para Investigar las Detenciones Arbitrarias solicita que el Committee on Homeland Security and Governmental Affairs por deberes de carácter institucional, envíe su oportuna y adecuada respuesta a la siguiente dirección postal: Apartado Postal 688, Valencia 2001, Carabobo, Venezuela.

3.- Que en virtud del estricto cumplimiento a la Resolución que amplió el Mandato de los Defensores de Derechos Humanos contenida en la:

Declaración sobre el derecho y el deber de los individuos, los grupos y las instituciones de promover y proteger los derechos humanos y las libertades fundamentales universalmente reconocidos

Artículo 9.3.a)

“…3. A los mismos efectos, toda persona tiene derecho, individual o colectivamente, entre otras cosas, a:

a) Denunciar las políticas y acciones de los funcionarios y órganos gubernamentales en relación con violaciones de los derechos humanos y las libertades fundamentales mediante peticiones u otros medios adecuados ante las autoridades judiciales, administrativas o legislativas internas o ante cualquier otra autoridad competente prevista en el sistema jurídico del Estado, las cuales deben emitir su decisión sobre la denuncia sin demora indebida;…” Omissis.

Se le remite al Comité el presente Informe anexo para que sea investigada la presunta responsabilidad del Gobierno de los Estados Unidos de América, en la “Voladura del Vuelo 77 de la empresa American Airline” el día 11 de Septiembre de 2001 y del posible lanzamiento de un “Misil” a la edificación donde tiene su asiento el Departamento de Defensa de los Estados Unidos, denominado “Pentágono”. En ambos casos he proporcionado la lista de personas fallecidas, lo cual podría constituir por las evidencias en actos de Crímenes que es de la competencia del Comité.

COMUNICACION DIRIGIDA AL CONSEJO DE SEGURIDAD DE LAS NACIONES UNIDAS: 08 DE MAYO DE 2006.

RELATIVA A: ATAQUE EN FECHA 11 DE SEPTIEMBRE DE 2001, A UNA AERONAVE COMERCIAL DE AMERICAN AIRLINES (VUELO 77) CON TRIPULACIÓN Y PASAJEROS CIVILES A BORDO, DONDE SE PRESUME QUE PUDIERON HABER SIDO ATACADOS POR ORDEN DEL DEPARTAMENTO DE DEFENSA DE LOS ESTADOS UNIDOS DE AMERICA, PREVIA AUTORIZACIÓN DEL PRESIDENTE.; Y EL OCULTAMIENTO DE INFORMACIÓN DEL ATAQUE (AIRE-TIERRA) O (TIERRA-AIRE) PROVOCADO PROBABLEMENTE POR UN MISIL EN LA EDIFICACIÓN DONDE TIENE SU ASIENTO EL DEPARTAMENTO DE DEFENSA CONOCIDO COMO EL “PENTAGONO”.

EL ESTADO ES PARTE EN EL PACTO INTERNACIONAL DE DERECHOS CIVILES Y POLITICOS

3.- Habida cuenta de las denuncias formuladas, por los medios de comunicación, familiares y testigos, inclusive de entrevistas realizadas con funcionarios gubernamentales, se presume que se trata de un caso de Lesa Humanidad donde pudiera tener participación el Departamento de Defensa de los Estados Unidos de América, previa autorización del Presidente; Y el ocultamiento de información del ataque (aire-tierra) o (tierra-aire) provocado probablemente por un misil en la edificación donde tiene su asiento el departamento de defensa conocido como el “Pentágono”.

6.- En el caso referido al Avión de American Airlines se ha presentado la versión de que el mismo se estrelló contra la fachada del Edificio conocido como el “Pentágono”, no apareciendo en el lugar, ni partes del Fuselaje, Alas y Cola del mismo, como se puede observar en la Imagen que se acompaña, que al presuntamente impactar en la fachada las Alas han debido quedar afuera del Edificio por el tamaño de la abertura.

7.- En el caso referido al Edificio conocido como el “Pentágono”, se presume que podría haber sido atacado con un “Misil Tierra-Tierra o Aire-Tierra”, ocultando las autoridades el verdadero origen que dejó un saldo de victimas militares y civiles en tiempos de paz, presumiéndose una simulación de “Ataque Terrorista”.

8.- Se informa al Consejo de Seguridad por estar presuntamente incursa en un grave delito de Lesa Humanidad uno de sus Estados Miembros (Estados Unidos de América) en el referido Consejo, para que se dirija al Señor Secretario General de las Naciones Unidas con el objeto de que se abra una Investigación.
