FISCAL DE LA CORTE PENAL INTERNACIONAL
Presente. –
Me dirijo a usted en la oportunidad de hacer de su conocimiento, que el Estado de Palestina ha cambiado su denominación por NACIÓN ISLAMICA DE PALESTINA, como por otra parte, el Señor Mahmoud Abbas ha sido desincorporado de la Presidencia del gobierno, y ha asumido las funciones del mismo, quien suscribe Príncipe Alí Muhammad bin Faisal Al-Saud, quien se encuentra ejerciendo tales funciones desde el exilio.
En el caso que nos ocupa, y que existe abundante información a través de hechos públicos, notorios y comunicacionales, de las acciones que se están sucediendo en mi país, producto de una guerra declarada por el Estado de Israel contra un grupo de civiles armados, quienes se resisten como ciudadanos victimas de la ocupación que de manera ilegal y sistemática ha mantenido el referido Estado de Israel en Palestina.
Sobran las resoluciones de las Naciones Unidas, tanto de la Asamblea General como del Consejo de Seguridad, totalmente ignoradas por el Estado de Israel, quien entre otros particulares es un Estado Miembro de la Organización.
Por tal razón, presento a usted con carácter de NOTITIA CRIMINIS, a objeto de que su Oficina abra una Investigación, basada en los siguientes hechos, que a continuación le presentaré, y a tenor de lo establecido en el artículo 15 del Estatuto de Roma.
LOS HECHOS
El día Sábado 6 de Octubre del año 2023, un grupo de habitantes de la población conocida como “Franja de Gaza”, cercada y ocupada por la fuerza en su mayor extensión territorial, acordada en el Plan de Partición establecido en la Resolución 181 (II de 29 de noviembre de 1947, desesperados y angustiados por estar cercados por Aire, Mar y Tierra, decidieron Motus Propio, emprender un ataque a la Potencia Militar Ocupante en legitima defensa, esto es del Estado de Israel, a los fines de lograr salir del cerco impuesto a la fuerza desde hace varios años como motivación principal.
Como respuesta el Estado de Israel declaró de manera pública la guerra a este grupo de ciudadanos, pero el ataque se realizó lanzando Bombas desde sus aviones, que ha sido no solamente desvastador en cuanto a la destrucción de edificaciones, sino que el mismo ataque no fue realizado a ningún Cuartel Militar, sino a viviendas familiares con un saldo de víctimas civiles que podrían estar en el orden de más de 4.500 fallecidos, más de 25.000 heridos, y aproximadamente 10.000 desaparecidos entre los escombros, siendo tales victimas hombres, mujeres, adolescentes y niños.
El Estado de Israel además, en la voz de su Ministro de la Defensa ha declarado que no le importa si se cometen Crímenes de Guerra, como en efecto los han cometido, y de manera premeditada han violado el Estatuto de Roma, en su Artículo 8, letra B, numeral 2, en sus acápites:
IV, Lanzar intencionalmente un ataque, sabiendo que causará pérdida accidental de vidas.
V, Atacar o bombardear, por cualquier medio, ciudades, aldeas, viviendas o edificios que no estén defendidos y que no sean objetivos militares;
IX, Dirigir intencionalmente ataques a edificios dedicados al culto religioso, la educación, las artes, ciencias o caridad, monumentos históricos, hospitales y lugares donde se reúnen enfermos y heridos, siempre que no sean objetivos militares;
XVIII, Utilizar gases asfixiantes, tóxicos u otros, o cualquier líquido, material o dispositivo similar; y,
XXV, Provocar deliberadamente el hambre de la población civil como método de guerra, privándola de bienes esenciales para su supervivencia, impidiendo incluso el envío de ayuda, tal y como prevé el Convenio de Ginebra;
CONSIDERACIONES
El Estado de Israel se ha olvidado que es miembro de las Naciones Unidas, y que una de sus principales obligaciones con la Organización, no era hacerse justicia por su propia mano, sino invocar precisamente la Carta, para que el Secretario General convocara de Urgencia al Consejo de Seguridad.
Señor Fiscal: Señalamos como presunto agraviante de estos hechos al Señor BENJAMIN NETANYAHU, quien ostenta el cargo de Primer Ministro del Estado de Israel, en la condición de determinador por la Comisión de Crímenes de Guerra contra la población civil que se encontraba habitando en la Franja de Gaza, para el momento de estos hechos.

PROSECUTOR OF THE INTERNATIONAL CRIMINAL COURT
Present. –
I am writing to you in the opportunity to inform you, that the State of Palestine has changed its name to ISLAMIC NATION OF PALESTINE, as on the other hand, Mr. Mahmoud Abbas has been disincorporated from the Presidency of the government, and has assumed the functions of the same, who subscribes Prince Ali Muhammad bin Faisal Al-Saud, who is exercising such functions from exile.In the case at hand, and that there is abundant information through public, notorious and communicational facts, of the actions that are taking place in my country, product of a war declared by the State of Israel against a group of armed civilians, who resist as citizens victims of the occupation that the aforementioned State of Israel has illegally and systematically maintained in Palestine.There are plenty of United Nations resolutions, both of the General Assembly and of the Security Council, totally ignored by the State of Israel, which among other individuals is a Member State of the Organization.For this reason, I present to you as NOTITIA CRIMINIS, in order for your Office to open an Investigation, based on the following facts, which I shall set out below, and in accordance with Article 15 of the Rome Statute.
THE FACTS
On Saturday, October 6, 2023, a group of inhabitants of the population known as the “Gaza Strip”, encircled by a Wall, and occupied by force in its largest territorial extension, as agreed in the Partition Plan established in Resolution 181 (II) of November 29, 1947, desperate and distressed at being encircled by Air, Sea and Land, desperate and anguished at being encircled by Air, Sea and Land, decided Motus Propio, to launch an attack on the Military Occupying Power in self-defence, identified as the State of Israel, in order to get out of the encirclement imposed by force for several years as the main motivation.
In response, the State of Israel publicly declared war on this group of citizens, but the attack was carried out by dropping bombs from its planes, which was not only devastating in terms of the destruction of buildings, but the attack itself was not carried out on any military barracks, but on family homes with a civilian death toll that could be in the order of more than 4,500 dead, more than 25,000 wounded, and approximately 10,000 missing in the rubble, such victims being men, women, adolescents and children.
The State of Israel, in the voice of its Minister of Defence, has furthermore stated the following: “I ordered a total siege on the Gaza Strip. There will be no electricity, no food, no gas, everything is closed. We are fighting human animals and we are acting accordingly”, as they have indeed materialised, and have premeditatedly violated the Rome Statute, Article 8, letter B, numeral 2, in its subparagraphs:
IV, Intentionally launching an attack, knowing that it will cause incidental loss of life.
V, Attacking or bombing, by any means, towns, villages, dwellings or buildings which are not defended and which are not military objectives;
IX, Intentionally directing attacks on buildings dedicated to religious worship, education, the arts, science or charity, historical monuments, hospitals and places where the sick and wounded gather, provided they are not military objectives;
XVIII, Using asphyxiating, poisonous or other gases, or any similar liquid, material or device; and,
XXV, Deliberately starving the civilian population as a method of warfare, depriving them of goods essential to their survival, including by preventing the delivery of aid as provided for in the Geneva Convention;
CONSIDERATIONS
The State of Israel has forgotten that it is a member of the United Nations, and that one of its main obligations to the Organisation was not to take justice into its own hands, but to invoke precisely the Charter, so that the Secretary General would urgently convene the Security Council.
Mr. Prosecutor: We point out as the alleged perpetrator of these facts Mr. BENJAMIN NETANYAHU, who holds the position of Prime Minister of the State of Israel, in the capacity of perpetrator for the commission of war crimes against the civilian population living in the Gaza Strip, at the time of these facts.
